Late in the day, Edelstein seemed to catch Jackson -- and Cunningham's lawyers -- by surprise when he produced a copy of an anonymous one-page flier that was circulated in the 31st District on primary day.

The flier carried a copy of the Jersey Journal's masthead, and purported to detail a court decision to impose a suspended sentence on Smith, Cunningham's opponent, for an altercation he had been in weeks earlier. The flier was false, as no charges had ever been filed against Smith, the Jersey City Council President.

After a lengthy sidebar, Edelstein was permitted to ask Jackson about the flier. Jackson said he had seen it on primary day, but denied having any involvement in producing or distributing it. Edelstein also asked Jackson if a writer for the Urban Times News had been involved in producing the flier.
