Robert Menendez, D-Union City, will not face a primary contest in the 13th District congressional race after all.</font> <font face=arial size=2>: Administrative Law Judge Elinor Reiner on Thursday ended the candidacy of Edgar Martinez, finding his nominating petitions did not contain a sufficient number of valid signatures from registered voters and that two circulators hadn't actually circulated the petitions.</font> <font face=arial size=2>: The move left the five-term congressman unopposed in the June 4 Democratic primary and virtually assured of victory in November.</font> <font face=arial size=2>: Martinez, the deputy police director in Jersey City, who is aligned with Mayor Glenn Cunningham, will not appeal the decision, his attorney said.</font> <font face=arial size=2>: Menendez, the fourth-ranking Democrat in the House and chairman of the Hudson County Democratic Organization, challenged the petitions on grounds that some voters had been misled and others were ineligible because they were Republicans, not registered to vote, or didn't live in the district.</font>
