URBAN TIMES NEWS HARTNETT GOES PROACTIVE by Steven Glazer (Jersey City) County Executive Bernard Hartnett asked for and got a temporary restraining order stopping the creation of new election ballots from Hudson County Superior Court Judge Arthur D'Italia. The temporary measure stays for just tow days the creation of the ballots by the County Clerk, Janet Haines. Hartnett's attorney argued that his client was concerned that the wording and design of the ballot might not make perfectly clear that there was to be both a primary election and a special election. Counsel for Tom DeGise, Hartnett's would-be opponent in the upcoming contest saw no harm in the temporary restraint until the case could be heard on its merits in just two days' time, when the gloves would presumably come off. Judge D'Italia placed a conference call from the bench to include DeGise's legal representative, so he could participate though not present in the courtroom. Appearing also was Joseph Sherman, Counsel for Hudson County, drawing the objection of Hartnett's representative who maintained that the County was not an "interested party." Attorney Kevin Marino filed the suit on behalf of Hartnett against Janet Haynes, the County Clerk, objected to the Sherman's appearance saying that Sherman was not an interested party and did not represent an interested party. Marino told the court that he had advised the County Clerk in advance of the action so that her office could have been represented if so desired. "You are a very interesting lawyer," said Judge D'Italia, "but you cannot be here (in this court) without a client. It was unclear to the court whom Sherman would represent in the matter. |
