: KENNY BILL HELPS FAMILIES DEAL WITH GRIEF OF LOST LOVED ONE

: HOBOKEN - A Senate committee today approved a bill which its sponsor, Senator Bernard F. Kenny Jr., hopes will prevent what happened to the family of the late Hoboken civic leader Anna Fontana from ever happening again.

: "If good comes out of the travesty which was inflicted on the Fontana Family when Anna Fontana passed away, then that may be the only consolation," said Senator Kenny, D-Hoboken.

: Senator Kenny's bill, S-1534, would require hospitals to establish notification procedures for families of a patient who dies at their facility. The measure would upgrade the requirement from an existing regulation issued by the Department of Health.

: Peter and Frank Fontana said their acutely-ill, 83 year-old mother died last May at St. Barnabas Medical Center in Livingston, but that hospital staff initially told them simply that she was no longer a patient at the facility. Meanwhile, it wasn't until a full 10 hours after her death at 2 a.m. that morning that the family learned her body, in fact, had been transported to the hospital's morgue.

: "It's hard enough dealing with the loss of a parent or any close relative, but to put families through the uncertainties related to misinformation is unconscionable," Senator Kenny said. "This family couldn't find their mother's body for hours after her death."

: The Senate Health, Human Services and Senior Citizens Committee approved the bill at a meeting held today at Children's Specialized Hospital in Mountainside. It now awaits action by the full Senate.

: A doctor treating Mrs. Fontana claimed he notified her family, but the family denied they ever received a call and the hospital later disputed his claim.

: The Kenny measure would require confirmation and written documentation that notification of a patient's death had been made to a family member or to another designated person.

: Mrs. Fontana was the supervisor of elections for Hudson County in the absentee ballot division for nearly 30 years and was a former vice chair of the Hoboken Republican Party for 20 years.

: A subsequent probe by State Board of Medical Examiners cleared the doctor of any wrongdoing on grounds there was no state law requiring doctors to contact anyone concerning the death of a patient. Senator Kenny's measure would alter that situation.
