Yes... Joe Rakowski maintained his position on the City Council and all voting rights during his tenure as Acting Mayor. In fact...he was seated as Council President during the July reorganization, which in turn gave him the reins of the City as Acting Mayor.

Just as in today's situation, if the City Council cannot select an acting Mayor from those putting themselves forth as potential candidates for the position, the law delineates an order of succession that begins with the Council President.

When Gerry McCann was removed by the courts, Marilyn Roman was Council President and therefore became Acting Mayor. In July of that year the City Council did its annual reorganization and ousted her as Council President and seated Joe Rakowski in her place.

Since the Council under Schundler passed an ordinace making the Council Presidency a four-year term running concurrent with the Mayor's term, Harvey cannot be removed in a July Reorganization, and will maintain the position as Acting Mayor until the special election is held in November.

: Harvey Smith is now Acting Mayor. My understanding is that he also is still a member of the City Council and is the Council President.

: Is the same true for Interim Mayor? If a Council-member becomes Interim Mayor, do they remain on the Council.

: Jersey City saw this about a dozen years ago when Rakowski was Interim Mayor. I don't remember if he stayed on the Council.
