Big Cat Gets Fatter- Scarinci Gets $92,000 JCRA Raise Urban Times News April 4-April 10, 2003 Steven Glazer Jersey City-Attorney Donald Scarinci got approval from The Jersey City Redevelopment Agency, which lie controls, for an increase in his annual billing well beyun : the contract's annual cap of $125,000. Scarinci was appointed general counsel to the agency by the introduction of a "pocket resolution° slipped on to the agen- da by Chairman E. Junior Maldonado min- utes before commissioners voted on the contract late last spring. Commissioners said they had no time to carefully read the document but that Maldonado assured them that it was nothing out of the ordinary and vv-as capped at S 125.000 a year and urged them to approve it as a routine matter. "This increase alone, a little more than half way through the contract's calendar year, closely approaches the total compensation commissioner were told Scarinci would receive for legal work." said commissioner Oren Dabney Closer reading of the contract by city lawyers revealed that the appointment was a dual appointment both as general and special counsel to the agency, rendering the cap meaningless. Those city attorneys also pointed out that the resolution abdicated decision-making authority over the agency's operation and control to Scarinci. Officials in Jersey City's legal department were horrified when they learned of the authority the agency had given Scarinci over the agency, apparently including the authority to determine his own compensa- tion. At that time, City attorneys did a thor- ough analysis of the contract and supporting documents and asked the State's Attorney General to look into the matter. Mayor Glenn Cunningham was alarmed at the prospect of the Scarinci hav- ing what amounted to a blank check and virtual control of the agency at the time the contract was originally approved. Cunningham cited examples of Scarinci's billing that completely disregarded contract caps or maximums. In Union City where Scarinci is Counsel, his contract is capped at 5500.000 for the year, but the Union City Business Administrator said that Scarinci had passed that amount halfway through the year. Recently Scarinci asked for and got Freeholder approval for a S70,000 increase to a contract with the County of Hudson capped at S275,000, a 25% increase.
