The manager of the Booker T. Washington Public Housing complex in Jersey City is accusing City Council President L. Harvey Smith of shoving him and cursing at him during a brief confrontation at the complex yesterday, where Smith was campaigning for the upcoming state Senate primary.

Smith, who is running against Jersey City Mayor Glenn D. Cunningham for the Democratic nomination to the Senate seat in the 31st District, denied shoving the man, Darrell Laval, and called the complaint politically motivated.

"I put my hands on no one," Smith, who was not arrested, said yesterday

: L. Harvey Smith was named in a JCPD complaint at 2:45pm this afternoon by victim Darrell Laval and witness Al Carr that Smith assaulted Laval at 78 Fremont. The report states that Laval, "manager at the Booker T Housing Complex, was walking through the grounds when he spotted L. Harvey Smith standing outside 78 Fremont which doubles as a residence and a community center. Mr. Laval approached Smith and said Hello at which time Mr. Smith stated, 'I have nothing to f***ing say to you,' and then got close to Laval and pinned him to a wrought iron fence and stated, 'You'll get yours,' The report, JCPD #2003-00013622 says Smith then shoved Mr. Laval. A housing maintenance Supervisor, Al Carr who witnessed the incident intervened, at which time Mr. Laval walked away from Smith to report the incident to us(JCPD). Mr. Laval delcined any medical attention."
