Clearly, there's no expectation of privacy for speech left on an answering machine as described by Mr. Zimmerman. Perhaps the exception would be for a telephone recording device in the service of a health care professional, clergy, or a lawyer.

As I've not heard the tape in question (and even then one would need either an admission of guilt or proof of identity by spectral analysis), I, of course, can't comment on this specific situation. But, making a threat of harm to someone's family is reprehensible UNDER ANY CIRCUMSTANCES! Doing so anonymously amplifies the offense through cowardice.

In case it was misunderstood, my "taper" post was intended as a poke at the typo with the hint that the Board was turning into a zoo! I did not intend any comment on the actions of Marc Zimmerman. If the situation is as Mr. Zimmerman describes, he acted with compasson and restraint.
