Justices appear split in remap case Tuesday, April 29, 2003 By HERB JACKSON How the court rules could change what towns are in what districts in this November's elections, when all 120 legislative seats are on the ballot. But several justices indicated they were leaning toward sending the whole case back to trial court so more facts could be developed, and no time frame was set for a ruling. The June 3 primary is being held using the disputed map, which was developed in 2001 after a non-partisan tie-breaker, Princeton University Professor Larry Bartels, sided with Democrats against Republicans on a special bipartisan commission. The new map helped Democrats that year win control of the Assembly and a 20-20 split in the Senate after a decade of solid Republican control of both houses. Republicans lost two federal court challenges to the map in 2001, but they hit pay dirt in state appeals court in January when a three-judge panel ordered the map redrawn. The panel ruled that since Newark and Jersey City were spread among three districts each rather than two each, the map violated a clause in the constitution that limits division of municipalities. The Supreme Court put the appeals court ruling on hold, however, while it considered the case. For the rest of the article, see the link:
