CUNNINGHAM ASKS COURT TO FREEZE HCDO ACCOUNTS Jersey City—A hearing is set for Tuesday May 27 in Superior Court in a suit by Mayor Glenn D. Cunningham to freeze the accounts of the Hudson County Democratic Organization and its candidates for illegal campaign funding. Attorneys for Cunningham said that the HCDO has illegally contributed $158, 275. 82 to the campaigns of candidates Harvey Smith, Janet Hayes, Elba Perez Cinciarelli, and Joseph Doria. This, say the attorneys, is according to documents filed by the HCDO itself as of about May 5, being 29 days prior to the election. Since then, the candidates have spent additional hundreds of thousands of dollars on advertising, campaign literature and campaign functions. “NJSA 19:34-52 states that no state, county, or municipal committee shall, prior to any primary election endorse the candidacy of any candidate for party nomination. The courts have interpreted this to mean no endorsement by the party or contribution of dollars by party. In reviewing the online reports filed by the candidates, only Doria has raised any money independently. Harvey Smith is clearly bought and paid for 100% owned outright, being given his entire war chest and campaign expense. I expect that we will prevail to freeze the accounts of the HCDO to prevent any further illegal acts,” said attorneys for Cunningham.
