Top News Wednesday, June 04, 2003 Sometimes truth is stranger than fiction. But yesterday, a bit of nasty Election Day fiction was distributed in Jersey City and Bayonne because the truth was apparently just too tame. According to a flier that was made to look like a Jersey Journal news item, Jersey City Council President and state Senate hopeful L. Harvey Smith "was convicted of aggravated assault on the manager of a public housing complex and sentenced to 90 days incarceration." The flier, which was dated "June 2, 2003" and carried The Jersey Journal nameplate without authorization, misrepresented the facts of a court case detailed in a May 9 Journal article about Smith and Darrell Laval, the manager of the Booker T. Washington housing complex. Laval had accused Smith of shoving and cursing at him April 23 when Smith was campaigning at the complex. Smith denied there had been any physical contact and filed a harassment complaint against Laval on April 24. In turn, Laval filed a formal complaint against Smith. Both and Smith and Laval withdrew their complaints when they appeared before Municipal Court Chief Judge Cynthia Jackson on May 8. Before walking into Jackson's courtroom, Smith and Laval shook hands and spoke privately for a few moments. The unknown writers of the deceitful flier further invented the outcome of the case to say the sentence for the veteran educator and councilman "was suspended so Smith will not be locked up, but he must perform 300 hours of community service." Smith was running against Jersey City Mayor Glenn D. Cunningham and Bayonne attorney Vincent Militello in yesterday's 31st District Democratic primary. Smith called the flier "a desperate move" on the part of Cunningham supporters "who don't have any real issues to talk about. They're playing the community as ignorant." Stan Eason, Cunningham's spokesman, said neither Cunningham nor any of the other candidates on his slate was responsible for the flier.
