: Statement of Richard Dally:
: On Friday, April 1, 2005 at approximately 4:20 p.m. Mr. James (Jimmy) King approached me in front of 518 Summit Avenue and asked me, Richard Dally, to speak with him privately. I replied, "Anything you can say, you can say in front of everyone." At this point he asked me to take 2 steps toward him, and I complied. He extended his hand to shake, and I reciprocated by shaking his hand. Mr. King would not release my hand, as he continued to squeeze my hand harder and pull me closer to him while advancing towards me. I asked him to release me, but he would not. He then told me that if I ever came near his house again, he would "Fuc.king kill me!" Once again I asked him to release me and he did not. It was at this point that Mr. King took his finger and drove it into my forehead several times. After that I was released from his grip, and I proceeded to call the police, and Mr. King began walking back in the direction from which he came. It was at this time that a green pickup truck with a white male and black male drove by shouting to me that I better get out of here. Once the police came I made my report. Three other people witnessed this crime: Jay Padilla, Ronald Davila, and William Del Rio.
