14. CREATE Charter School does not maintain proper filing and record retention.

As part of the review, certain employee files were requested but, some of which could not readily be found, The OCI review of the employee files revealed that there were inadequate documentation of employment terms that could easily be corrected with employment contracts, adequate recording of salary history, proper filing and retention of employment forms including federal W-4's and I-9's, and completion and filing of performance evaluations.

Recommendation

The CREATE Board of Trustees must establish policies and procedures regarding the filing and records retention of critical financial, payroll and employment functions some of which are required by federal and state labor. and tax laws.

15. CREATE Charter School may not be in compliance with the charter regardingg the number of board members.

The charter for CREATE Charter School requires that the Board of Trustees consists of nine members. However, at the time of this review, there were only seven board members. According to the charter requirements, CREATE Board of Trustees does not have the correct number of board members.

Recommendation
The CREATE Board of Trustees must establish policies and procedures that ensure compliance with its charter.

INTERNAL CONTROL COMMENTS

The Office of Compliance Investigation noted the following deficiencies in internal control procedures that should be addressed by CREATE Charter High School.

1. Purchasing Policies and Procedures.

CREATE Charter High School does not have a purchasing policies and procedures manual. School representatives stated that they are in the process of developing purchasing procedures to include the provisions of N.J.S.A. 18A: 18A et seq.
